Terms of Service

These Terms of Service govern access to and use of ScripTrade at scriptrade.ai (the “Platform” or “Service”). By creating an account or using the Service, you confirm that you have read and accepted these Terms. If you do not agree, do not use the Service.

Seller identity

1. Service scope

ScripTrade is a software-generation tool. It lets users describe a trading strategy in natural language and obtain MQL5 source code, and potentially other supported formats in the future, for Expert Advisors compatible with trading platforms.

ScripTrade is not an investment firm, broker, financial adviser, signal provider, or asset manager. Generated code reflects the user’s instructions. Every decision to use it on a demo or live account remains the user’s responsibility. Read the Risk Disclosure.

2. Eligibility and account security

You must be at least 18 years old and provide accurate, complete, and current information. You are responsible for protecting your account, using secure authentication methods, and promptly reporting suspected unauthorized access. We may restrict accounts that breach these Terms or create a security risk.

3. Plans, subscriptions, and credits

The Service may offer monthly or annual plans, generation allowances, modification credits, and one-off credit packages. Current prices, taxes, included features, and limits are shown before purchase.

Payments are processed by Stripe. Subscriptions renew automatically unless canceled before the renewal date. Cancellation takes effect at the end of the paid billing period unless the law requires otherwise. Unused monthly allowances do not roll over unless a plan expressly says so.

Listed prices are not subject to VAT: transaction without VAT application under Article 1, paragraphs 54-89, Law 190/2014 — Italian flat-rate tax regime (regime forfettario).

Before every renewal, the applicable pricing terms remain available in the My Plan area.

Credits, generation allowances, and bonus or trial generations are tied to the account, cannot be exchanged for money and are not refundable except as provided in section 4 or by law, and are lost when the account is deleted. Before deletion, the Service shows the balance that will be lost.

4. Right of withdrawal and refunds

If you are a consumer resident in the European Union, you have the right to withdraw from the contract within 14 days of subscribing, without giving any reason.

The Service provides digital content and is supplied immediately after purchase. At checkout you are asked to expressly consent to immediate performance of the Service and to acknowledge that, once you start the first generation of an Expert Advisor or use the included credits, the right of withdrawal lapses for the performance already carried out, pursuant to Articles 51 and 59 of the Italian Consumer Code (Legislative Decree 206/2005).

If you withdraw within 14 days without having used the Service (no generation started and no credits consumed), you are entitled to a full refund of the amount paid. If you requested immediate performance and partially used the Service, any refund will be proportional to the part not performed.

To exercise your right of withdrawal, simply send an explicit statement to support@algowizard.ai, indicating your name, account email, and subscription date. You may, without obligation, use the model withdrawal form included at the end of these Terms. Where due, the refund will be issued within 14 days of the notice, using the same payment method used for the purchase.

For one-off credit packages, you may request immediate allocation and immediate start of the Service. If you use credits during the withdrawal period, the right may end for digital content already supplied and a proportionate amount may be due for the part of the Service already performed; unused credits remain subject to the applicable withdrawal rules.

Confirmation of the contract, including the applicable terms, price, and renewal conditions, is sent to you by email on a durable medium at the time of purchase.

5. Intellectual property

As between you and ScripTrade, you may use, modify, and distribute the Expert Advisor source code generated for you, subject to third-party rights, applicable law, and these Terms. You remain responsible for reviewing the output before use.

ScripTrade retains all rights in the Platform, underlying software, prompts, interface, brand, site content, and other Service materials. You may not copy, decompile, resell, or create derivative services from the Platform except where mandatory law permits it.

6. Acceptable use

You must not use the Service to:

• carry out illegal, abusive, deceptive, or fraudulent activity;
• generate code intended to manipulate markets, bypass broker restrictions, or violate third-party rights or terms;
• probe security without authorization, disrupt the Service, automate abusive traffic, or evade technical limits;
• resell, share, or redistribute access without written permission.

7. User content

You retain your rights in content you submit and confirm that you are allowed to use it. You grant ScripTrade a limited, non-exclusive license to host, process, and transmit that content only as needed to operate, secure, and improve the Service in accordance with the Privacy Policy.

8. Disclaimers and limitation of liability

The Service is provided on an “as available” basis. Automated validation reduces errors but cannot guarantee that generated code is error-free, suitable for a particular purpose, compatible with every environment, or profitable. To the maximum extent permitted by law, ScripTrade is not liable for trading losses, lost profits, lost data, or indirect loss arising from generated code or temporary unavailability. Any aggregate contractual liability is limited to the amount paid for the Service in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes fraud, willful misconduct, death or personal injury caused by negligence, mandatory consumer protections, or any liability that cannot legally be excluded or limited.

9. Suspension and account closure

You can delete your account at any time from Settings > Danger zone, or ask support to do it. A subscription that renews must be cancelled first; a subscription already cancelled ends when the account is deleted, without a refund for the remaining period, and any remaining credits, allowances and generations are lost. This does not affect the right of withdrawal in section 4, which you can exercise before deleting the account. ScripTrade may restrict or suspend access when reasonably necessary for security, legal compliance, non-payment, or a material breach, with notice where reasonably possible. Provisions that by their nature should survive closure remain in effect.

10. Changes to the Service or these Terms

We may change features, plans, prices, or these Terms. We will give reasonable advance notice of material changes by email or an in-product notice when required. Continued use after the effective date means acceptance of the revised Terms, unless applicable law requires a different process.

11. Governing law and disputes

These Terms are governed by Italian law. Where mandatory consumer law applies, consumers may bring proceedings before the courts of their place of residence or domicile and retain any protections granted by the law of their country.

These Terms are drafted in Italian. Versions in other languages are translations provided for convenience: in case of any discrepancy, the Italian version prevails, without prejudice to the mandatory protections afforded to consumers.
